Strictly speaking falling through our atmosphere is not free falling as the atmosphere offers resistence. However in the skydiving parlance and colloquial usage free falling is the time when the parachute is not open.

So if the chute is opened, it aint a free fall.

If the parachute is not open, yes, for all practical purposes. Once the parachute opens, he is no longer freely falling sinvce the air resistance will slow down the descent and help him land safely.
