the letters are to me and signed by him. I am going to borrow a spy camera to get him on tape tampering in my mailbox He stalks me and tells lies all over the small town i live in. I am afraid he will get more dangerous than he is now... the local police do come when they are called but the just talk and then take him home. I live alone with my 7 yr old daughter and a gorgeous chocolate lab (turned 11 yrs old today). The dog is still a good watch dog but I am scared of this mans violent traits. Any advice would certainly help pleazzzzzzzzz.. We have been separated since july of '05 and divorced went final jan 17. he refuses to spend time with our daughter he is just obsessed with me. I do have a no contact order signed by the judge but haven't seen that it has helped

call the police immediately...even if he left threatening letters in a public place it would still be considered stalking or terrorizing. I have been through this myself. You definitely need to start documenting everything and get the police involved NOW. You can also get resources through the rape and abuse crisis center in your area.

Well, I can tell you that tampering with anyone's mailbox is a Federal offense, and that includes any non-postal carrier placing anything inside.
In your case you are DEFINATELY being stalked, and so you need to contact the police, the postal service, and even the news media. If you can get a reporter or editor at your local paper interested, you might be able to get a stronger response from the police then you are currently getting. That will also have the effect of creating public information on paper that has been widely-published, not just some police report that may not see the light of day. The police in your town probably won't like any kind of publicity that makes it look as though they are not taking this seriously, and so they may become more proactive in helping you to end the threat posed by this guy.

The law you are thinking of prevents a person from putting anything other than US Mail in a mail box that is designated for the purpose. Check with your post office for the details of this law.

The No Contact order does not stop him from contacting you. It allows you to have the police charge him with violation of the order IF you notify them of the violation.

If it is a violation of the order to send you notes, then turn the notes over to the police along with a violation of a No Contact Order charge.

If he is allowed under the order to send you mail, then you will need to set up the surveillance camera and document him delivering the notes in person. Again this is only a violation if the No Contact Order states that he is not allowed on your property.

You may also be able to charge him with trespassing if you have properly notified him that he is not allowed on your property. Ask the police or contact a lawyer for advice on how to notify him so that his presence on your property can be prosecuted under trespassing laws.

Since the police can be witnesses to his presence on your property & his violation of the order, you will need to look into pressing charges against him. The police may not be allowed under local rules to charge him with a crime until you actually tell them to. This is something else to check with a lawyer.

In addition you may be able to file either a civil or criminal harrassment lawsuit. Once more consult a good lawyer who can advise you on which if any of these options will work in your case & what other options may be available to you.

Unfortunately for you harrassment is too often viewed as a joke until someone is seriously hurt or dies. Then of course everyone starts explaining why they were completely unaware of the problems they were laughing about. There are legal methods of harrassing him if he doesn't leave you alone.

Get a lawyer and start fighting back or leave town, do not leave a forwarding address and change your name. Drastic, but abandoning all that you have known is sometimes the only way to escape a stalker other than killing him.

Present the papers that he has left in the mail box to the States Attorney. Press charges on the grounds that he violated the no contact order. Ask for assistance in proving that he is tampering with the mail box from the States Attorney and the Postmaster General. You can request that the box be finger printed.
Get that video camera installed ASAP. Our town is burying a sweet hard working mother of three (1,2,3 year old kids) because the jealous obsessed ex-spouse killed her and dumped her body out in the scrub.

there is a law its a federal law he is violating called tampering with the mail you really shouldn't need a camera if the letters are placed in the mailbox with a post office stamp ( i refer to the stamp that cancels out the further use of the postage stamp) then it proves those letters are being placed in there by someone other than an authorized agent. and if he is signing them then that proves he is himself or having someone else place them in your box if the police are tip toing around this inform the postal service they have thier own investigation team postal inspectors.

You need to contact the postal authorities. Even more, you need to tell the police that he is violating the judge's no contact order, violating stalking laws, and you want him arrested.

cal.411. that way your call is recorded by law it cant be erased from there files by law that is and go to the judge as well and contact the.f.b. i. and let them know what.s going on they get them in line very quickley belive me on this matter sounds like your local law has failed there oath . . my opion?
