My landlord has me and my family living in a home that has a damaged rug that was damaged due to 2wo floods that occured because of pipe problems. (Remember it's his home and his pipes that caused our flooring to be damaged) The rug is filled with sewage water. 2wo the basement has mold on it walls which is definetely unsanitary and can cause serious breathing problems (lung infection, asthma, etc.) As a dweller to the home I would like to know if I were to call the city (NYC) 311 and complained about the conditions if the landlord at his will could remove us from his home with out legitament reason. The reason he might want to react like this is because we are paying low rent compared to other residents in the area. I've lived here all my life but after my parents died things have fallen apart drastically.

Here is what you need to do
1) If you signed a lease you need to
a) send your landlord a certified letter outlining the problems. Keep a copy of the letter.
b) Advise him that he has seven (7) days in which to correct the problems in the dwelling or else he is in breach of the contract. You should be able to break your lease at that juncture ( but this is dependent on the state you live in) Note:- DO NOT WITHHOLD RENT while waiting on a response from the landlord which can be either he fixes the problems or just ignores you. .
2) If you do NOT have a lease, you will still need to do the same things- send the letter outlining the problems and the time period he has in which to fix them
3) If the problems are not rectified, take the next month's rent to your county court house. They should have a civil division where you can open an escrow account and pay the rent there until the case is resolved. Once you have opened the account, send another certified letter to your landlord advising that all rents will be paid to the courts until the unsanitary conditions are fixed. Also keep a copy of this letter for your records.
4) A landlord CANNOT remove you without just cause. He would have to go to court to take eviction proceedings to have you removed from the property. This is why I stated before- do not withhold rent. Whether or not your home is rent controlled and you are paying less than the others around you does not give the landlord just cause to keep a slum.

It doeas not matter how much rent you pay in any state, the landlord is to keep the places he rents livable. Those conditions are not liveable and the health department needs to be notified.
You can with hold rent untill problems are fixed.

call your health department or OSHA and get an evaluation. tell them whats going on, also if you can afford it get a lawyer
