That is actually a good question since he claims he is part of the Executive when it suits and vise verse. To me it appears as though he really does have something to hide. Therefore he is dancing on the tightrope trying to dodge Congressional oversight. Unfortunately many things about this administration draw startling parallels to the Nixon White House and I shudder to think what revelations may come to light once they are finally out of power.

The Vice President is part of the Executive, he is elected along with the President on the same ticket. His role in the Senate is largely symbolic. In short, he cannot claim he is part of the Executive to dodge Congressional oversight by claiming Executive priviledge and then turn around and claim he is not part of the Executive to again dodge Congress.
Can you see where this might defy the whole concept of a Separation of powers and oversight in general? Or are you too partisan? I suspect if it was Al Gore who had been making such an assertion during the Clinton Administration your position would be different on the matter.
No one is saying that he cannot be one of the other, but he cannot be both and there is nothing partisan about that belief.
