she's 17, I'm 20. we both live in kansas. the age of consent is 16. will I go to jail if/when we have sex? I'm confused by the law. I don't know if 16 is the age she's legal to have sex, but only with 16 or 17 year olds. Also, can a 16 year old have sex w/ some 45 year old guy? I am against that. anything more than 4 years I'm against.

if the age of consent is 16..then you can't go to jail..if it's been made a law...then you're fine.
a 16 yr old, if she wanted to, have sex with a 45 yr old man...could...but i dnt agree with it.

Once someone reaches the age of 16, he/she is considered by law to be able to make his/her own decisions about whether or not to have sex.

So that means that, if consensual, it is legal for a 16 year old to have sex with any other person that is 16 or older. So, yes, you are allowed to have sex with her if it is consensual, and no you will not go to jail.

You could! She can give consent, but her ability to be coerced into having sex with a 20 year old you would likely find you being charged. They don't all get reported and not all are charged if they do! Many are though, especially if they become pregnant!

The age difference and a 20 year-olds life experience is too great. It won't matter when she is 18, but not before! At least that has been my experience when investigating child abuse!

I don't see any difference between a 16 year old and a 21 year old! Where the line is usually drawn is 18 and below for the male. Sometimes an 18 year old if still in school!

Age of consent in Kansas is 16, which means that you can be 40 and she can be 16 and it'd be legal. Tag it and bag it kid! Just don't take pics or video!!!!

KK IS WRONG! The legal age of consent is 16 in Kansas! By the look of the answers below me, it seems that people don't understand the concept of "Age of Consent." It even appears that there's a pedophile down there too. Stay away from those 12 year olds, even if you think they're "lookin atcha all sexy."

If I were you, I would not risk it. She can be one day short of being 18 when you decide to have sex, and her parents might decide to become vengeful and get you. I would just wait until she turns 18 because she is legal by all means. In Louisiana, there are actually rules in place for not only heterosexual couples but also homosexual couples. 17 may be close to being an adult, but it still isn't it. In LA, the age of consent is 16 or so, but you still can be charged with statutory rape if you mess with a person under the age of 18. The age of consent really is a waste of time because parents find ways to get around it.

The age of consent = the age of SEXUAL consent. It's okay to have sex. However, aren't you a bit close-minded? You make the age cut-off just a little higher than your own situation's so it's okay for YOU but not for others...? Come on now. Age shouldn't matter in a relationship, so don't judge others because it's not your right to interject with your own myopic opinion about how "moral" or "immoral" other peoples' relationships are.
