Me and my fiance bought a house and he hasnt been living here in ten years, I have been paying the mortgage and found out that my name is not on the mortgage. How do I go about getting my name on the house and buying him out

Well if he has the mortgage and you are not on title, you dont own the house.

You have to get refinance the home, get your own mortgage. You will also have to have him sign a quit claim deed. Since you were never divorced a court hasnt decided this issue. He can litterally tell you to go to hell and evict you.

If you are on good terms with him, get approved for a new mortgage and just have him come to closing so he can sign the quit claim. Maybe you make a deal and say I can get enough cash out to give you 5-25K I dont know what equity you have or what he put down originally, but that might work.

If you are not on good terms, you better hire a damn good attorney. Its his house. All he has to say is he was letting you live there for paying the mortgage. I hope you have something in writing.

Any time you live with someone and split the costs...

When you break up, make sure you get your name off everything their name is on or you could end up screwed over like you are right now.

Definitely talk to a lawyer.

And no matter what terms you guys are on now, he could still decide he wants the house and kick you out, because he owns the house. He never signed the title over to you, so why would you be making payments on his mortgage?

Wow, bad situation. Whatever happens, keep your fingers crossed and don't ever do it again! Don't pay things that don't have your name on them, especially that expensive. And don't trust an ex to pay your stuff for you. When you break up, you need to go through all the bills and seperate them out so you aren't sharing them anymore, or you end up getting screwed over like this.

If your name is not on the title or the mortgage, it's just his name, then technically you could move out and not pay another dime on that house and he would get in trouble on his credit.

You may be able to claim that he "abandoned" the house and left it to you. But like I said, get a lawyer and good luck.

First you have to show proof you been paying the payments, so you better off getting a lawyer an fileing a quick claim deed asap !!!
