If she took the pictures herself, it's not child porn until someone else downloads it --- because she is exempt from the laws intended to protect her (which would normally prohibit the taking and posting side of the process).

Pictures of naked minors are not "automatically" illegal. Pictures, for example, of naked kids playing on a nude beach or at a nudist resort, are perfectly legal. What makes them pornographic is context and / or purpose. If your girlfriend is striking a sexy pose for the camera, then the photo has a "prurient intent", and is child porn if she's a minor. If you expose yourself to another minor over a webcam then that, too, is criminal. And realistically, yes, the cops WILL care when one of the pictures eventually gets seen (and it will be, one day, somehow) by someone who knows the person in the picture, and reports it. Over a dozen kids at our local high school were charged - as adults - with possession and distribution of child pornography last year for trading around cellphone pictures of two topless 16 year old girls making out at a party. They are all stuck with the tag of "registered sex offender" FOR LIFE. Richard

Yes it would be considered Child porn. However, the law is grey when it comes to pictures that you post on a free web site. If she were selling them then most definetly. I would talk to her and tell her that what she is doing is dangerous. She is asking for trouble.

I don't think it would technically be porn if she did it herself and it's not anything directly sexual or obscene.
That being said, I think that you should talk to this girl and try to convince her to take the pictures and the links down. It could be really dangerous if some wacked-out pedophile sees it and can find her.
