When I turned in my notice at my last job they told me that they would pay me for my vaction time. I received a check for the last 80 hrs plus the vaction time they told me I was to receive. A year and a half later I got a bill from them saying that they didnt owe me the vaction time and it was paid to me in error. That I need to mail them a check for the overpayment in the amount of like $518.00.
I was told i was going to receive the money, They paid me a check that someone authorized saying I was owed the money, now they want it back. Is this legal?

Hopefully you still have some employment contract or paperwork stating that you get the vacation time, but if it were me, I would just ignore it, especially if it's been over a year. They only have two years to sue you for it (from the date they wrote you the check), so let them try to take you to court.

So they made an error and they took a year and a half to figure it out? I would check with a lawyer. Surely there is some attorney web site that someone could answer that question for you, for a reasonable fee or even free.

Tell them to take a hike. They told you you would get the money, they paid you the money, and that's that. They can't just decide a year and a half later that they want the money back. Too bad for them.

If you were due the money, no. If you believe you are entitled to keep the money because someone sent you the check (abiet in error) yes, you owe it to them, especially if you knew it was a mistake.

Call the labor relations board.

I believe that if a company pays vacation then that time was earned for you and in a company policy it should state that.

Read your policy, and I am sure that it will tell you what you are entitled to. I wouldn't pay them back until I knew for sure I didn't earn that time. Let them take you to court if you earned it.

I don't think so but everyone I know that was overpaid never got caught. I'd check with an attorney before giving those greedy incompetents a dime.

I'd ignore it. They authorized payment and signed the check. Too bad if their accounting system it so bad.

If they want money from you, let them file in small claims court.

I wouldn't worry about it.

no no no...not unless it's in a form you signed when you were hired that you were not to be paid unused vacation time.. there's alot of businesses that have such a thing. and there's an equal amount that don't. ask for something in writing with your signature.

No, it's not. They authorized the payment. You did not steal it and they should have known what industrial law entailed before acting in this manner.

If your vacation was due and payable, then what's the problem?
