there was a news story today about some sick pedophile guy, who takes pictures of kids and puts it on the web for other sick pedophile people to see.
he was even on a Morning talk show this morning . my question is why isn't that guy in jail? why is it taking the court system so long to get his guy off the streets?

coragryph... the guy said he takes their pictures. he even said there's nothing wrong with having sex with a three year old.

I have not seen the story you are referring to (posting links is helpful here) however unless the pictures violate a law, there is nothing the police can do. You did not say if they were nude pictures. You did not say where the pictures were taken. Just last night I read a chapter on the law as it applies to taking pictures in various places. Basically, you can take pictures of anyone that is viewable from a public place without their permission. Model releases are only needed if the pictures will be sold. You can not send a person to jail for saying he thinks it is OK to have sex with three year old kids no matter how sick that statement is.

Because the police and prosecutors would need to be able to prove that he is the one taking and posting those pictures -- and if the website is in a different state or country, that proof becomes much more complicated.

Law is not always a simple matter of doing what you think is best -- there are procedural requirements and burdens of proof that often complicate the process.

As far as anyone knows, they are pictures of clothed kids in non-sexual candid poses. Creepy as hell, but nothing illegal.

it is a disgrace and contrary to the ACLU position that he is exercising his right to free speech, he IS a pedophile.
