why should they be?
(1)They only send back to the server information that you previously gave to the server of yopur own freee will - and you made that decision to send it originally
and
(2) you have the option in your browser to send them or not and you have chosen to send them

When a private business does it, the Constitution has no relevance. It's only when the government does something that the Constitution is involved.

As far as the government goes, it would be because there probably isn't a single government employee that both understands both "cookies" and the Constitution.
