my stepson got hurt while at school during recess. the school is refusing to pay the bill because "it's never happened before".

You would need a personal injury attorney, one familar with bringing negligence actions based on landlord-tenant liabilty (that's the closest common topic to this issue).

The school's legal argument ("never happened before") is basically that the accident was not foreseeable, and therefore it doesn't matter if there was negligence because the harm could not be anticipated -- the legal term is lack of proximate cause.

But your attorney will be able to assess the laws of your jurisdiction and determine how likely that defense will be to work for them.

You need a personal injury attorney (the same type that do car accident claims usually handle this kind of stuff as well)
