I have been placed on PC following allegations surrounding paperwork fraud. I have a vehicle which is in my contract as 'business needs' and have been told that they can now come and take it. My argument is that I am available for work and on full pay whilst the case is investigated and im therefore waiting for a call to say come to work!
It states clearly on my letter that I am still bound by my contract of employment. Anyone know anything more on this or have ever suffered the same? please its urgent !

does it make any difference that I make a contribution of £109 every month as well as paying tax on it?
my company pay £430 and i pay £109 as it exceeds their contribution max

If the vehicle is Business Use ONLY (i.e NO private use = what is known as a 'needs' vehicle) then, yes, they can take whenever they like .. (suspended or not) ..

... however whilst you are suspended they are not asking you to do any work, so they do not need to provide any equipment (same applies to PC/Laptop etc).


NB. I'm surprised that you are allowed to keep it off premises = the Inland Revenue usually assume some element of Personal use if they discover you have access to the vehicle outside working hours (especially at the weekends).

Its the company's car and they can insist on its return, along with your work mobile phone, keys, etc. If they want you to return to your duties, then they will return the car. Make sure you keep a note of the days the car was unavailable for tax purposes.
If you are contributing to the car, then the employer should stop making this deduction from your salary for the duration of the suspension.

First of all your company can suspend you suspicions pending.

The car belongs to the company, you shouldn't have agreed to pay anything towards it, that is the company's responsibility because you needed it to carry out your duties for your employer.
If your employer decide to take the car you can't do anything about it because the car is registered to them not you.

Further if they take the car that means you have been sacked.

If I were your union rep then I would advise you to contact your employer to explain that you will not be making any financial contributions (tax or otherwise)towards the cost of the car the the time it is not available to you.

If they suspend you it MUST be with full pay - after a fortnight they must come up with an answer, if you are called to any meetings with them make sure you take a witness with you, contact ACAS for these details. My husband has just been through the same thing. www.ACAS.com

you are suspended on more than full pay, its on full benefits package, which includes the car (unless it is not for personal use).
