What possibilities does the TVPA open up?

It doesn't change anything really -- the Supreme Court has repeatedly affirmed that constitutional protections apply to anyone in US custody, regardless of citizenship. Based on the simple fact that the Constitution uses the word "person" and not "citizen" in the 5th and 6th Amendments.

And the TVPA been the law for 15 years, so there would have been plenty of opportunity for abuse earlier.
