I have been a stay at home mom and full time student for the past 2 years. I got a summer job while out of school for the summer and plan on leaving once school begins again in Sept. My hubby is currently active duty military(past 2 years) and he is stationed in Philly but we live in New Jersey. Our home of record remains in NorthCarolina, we still have NC Drivers Licenses and our vehicles remain registered in NC. I recieved a notice via certified mail today saying that I am being sued for a JCPenny CC from 2004. In NC the SOL on open accounts is 3yrs but in NJ the SOL is 6 years. Which applys to my situation? Any Advice?Thank you for your time.

First, the jurisdiction is usually indicated on the credit card agreement -- it may be South Dakota for all we can tell. You have to have the agreement.

Second, you should pay your bill and settle this appropriately. Even if you were to find a way to get out of it using some underhanded trick, it would still stay on your credit report.

Better to find a way to make payments and get to work on the remaining balance.

And next time, don't charge what you can't afford.

Comply with the court order with the assistance of a lawyer and tell your reason about it.

Start by calling some politicians.....many will help a wife who has a husband serving overseas. Let those that are bothering you know that you will be seeking help. Good Luck !
