We had an open house this weekend which was hosted by our realtor. When we returned after the open house we found out that a diamond ring and watch were missing. We are sick about this theft but are not sure who is liable.

Did you call the police and make a report? Then call the insurance company, if it was covered you are OK. Other than that-anyone can sue everyone and do. The courts and attorneys are the ones who win. In my humble opinion! I will say that REALTORS have helped the police find the bad guys many times due to this kind of thing happening. I have seen it in several cities across the country. If you file the police report and give the information to the REALTOR they can give it to the Association and if these bad people show up again, the Police will have more to go on and maybe get them in the end.

Sad to say, you are liable for this loss. With any kind of luck, your home owner's policy will pick it up, if you have the value of the ring separately declared on the policy.

As a realtor, I always advise clients who are having open houses to remove ANYTHING of value or get it under lock and key for an open house. While realtors generally use as much caution as possible, it's simply not possible to keep two eyes on everything going on in a house if the open house gets a bit busy. That's when tiny valuables tend to disappear.

And, believe it or not, there are groups of thieves who work open houses in upscale areas looking for just this kind of opportunity.

The person who took the item. You cannot hold the realtor responsible. I would go so far as to ask why you left such a valuable item unsecured in your home when you knew of the open house? Optimally your realtor would be too busy with the crowd to usher everyone through personally.

Well first you need to contact your home insurance to see if its covered. I would assume that the realtor since she is the one in charge of the open house should be the one liable since she is sopose to show the house on your behalf. Contact a lawyer to find out for sure.

what made you leave expensive stuff in the house in the first place ??? when you KNEW all those people would be walking about....
Actually YOU'RE responsible. Not the realtor, he/she didn't know you were leaving expensive jewelery in the house, did she know you OWNED such things ??? You need to contact your insurance and deal with THEM.

You are. Valuables should not have been left out.

Hopefully your home owners insurance will cover it.

If someone fell in your house you would be liable too.

your fault bcse you should have known better than to leave valuables out. when you have an open house where you are letting strangers in to your house you should box up all valuables and take them out of the house with you.
jewelry, electronics.. ipod cameras... things like that
