Our homeowner's association is proposing to restrict owners from renting out their house. Most of our community's residents are outraged. An association should only be concerned with the exterior appearance, maintenance and
noise levels and not have any say on what goes on INSIDE
the house. Of late, homeowner associations have been slowly trying to take away freedoms, ie: banning the American Flag after 911 in one Southern Florida community... So long as the exterior of the house is
kept up according to covenants, no one should be concerned
who lives inside. If they pierce our walls, is the next step telling us that we must not watch TV past 11 pm? -or worse?
Any input or information on this issue would be very much
appreciated! If you know of any laws in your state or personal experiences, please let me know. Thank you!

Here is Southern CA LOTS of HOA's ban renting the properties out. Far as I'm concerned....HOA's are the devil..which is why I moved out of ours and will NEVER live in one again.... They will pick at you and pick at you until you finally sell and get out of dodge.

Yep. I know of buildings in NYC that restrict an owner from renting out their unit at all for 2 years, and of condos in LA that restrict an owner from renting to anyone without approval from the HOA board, and good luck on getting that.

If you value your property, you will agree to the proposal.

Neighborhoods, statistically, DECREASE in value, the higher the percentage of rental.

The problem is the majority of homeowners rent out the house, move, and then leave the remaining neighbors to deal with the problems of the renters, reporting them for violations, etc.

My neighborhood is audited every two years by the HOA via tax bills...we are limited to 10% rental and we are at capacity for rental. We do not allow someone to rent a property 18 months after a purchase without HOA approval. We do not allow renters to have access to the pool and other key-access areas...that is reserved for the homeowner, and does not extend to the renter.

This is a very valid, real estate issue that is GROWING in popularity, and neighborhoods that incorporate the policy are seeing INCREASES in their property and is a SELLING POINT for their neighborhood.

Do what you want, but people that protest it, really don't care about the people who still have to live beside of renters that have nothing invested.

You DID buy a property controlled by a HOA, didn't you ? Yes, the HOA can do that, and probably will. There is absolutely nothing wrong with a HOA attempting to restrict occupancy to ownership only.

I suspect that, if you read the contract you signed when you purchased, you will discover that the HOA has reserved this legal right.

did you read you cc&Rs prior to closing?
you elected these yeehaws ---right?
then everybody get together and force them out.
get a new board.... state laws do not prevail here...you have your CC&Rs...as well as a community elected board....
get th board out and that will be your beginning.
