I rent an apartment and in the summer both the people next door and the one upstairs smoke outside. Thesmoke fills my apartment and it stinks and I am tired of smelling it. I get headaches. I have complained but the managers said nothing can be done! why do I have to be exposed to second hand smoke where I live? I pay rent here shouldn't I be able to live free of toxins? without having to close up all my windows in the middle of summer?

Tell the manager that it's becoming a health hazard to you, and that you'd like to be moved into another unit.
Maybe he could move you way far away from the smokers or possibly on the ground floor, since the smoke usually rises.

if the manager of the place doesnt want to do anything about it then your stuck, you do have the right not to have people smoke around you, but unless he makes a rule about tenants not smoking then they can smoke as much as they want.

although this might be costly your only options would be to find another apartment (in the complex) where people dont smoke or move

If you do not want to be exposed to smoke, you shall have to find housing in a 'smoke free facility'. Sorry, but your landlord cannot control the tobacco use of the other residents, especially if they use it outdoors.

nothing you can do,they have the right to smoke unless its a no smoking building and apparently its not,my suggestion is keep windows closed or move.

There is nothing you can do but get a really good air filter.

However, if I were you, I would put cabbage and vinegar in a large stockpot, boil it on the stove, and aim a fan in their direction.

so stop complaining and move to a smoke free environment. they have just as much rights to smoke as you not to breath it. maybe if you ask them to politely move to another location to smoke so it doesn't come into your apt.
