first of all each state is different as far as a restraining order pertains (check with the local police department on that states policy). Second being that your husband is in the military try contacting his commander and or the legal office at the place he is stationed. The legal office can advise you of your rights as a military spouse and may even assist you with restraining order. His commander can also take any moves necessary to prevent any harm coming to you or the children and also prevent him from getting into trouble plus you will have the backing of the commander. Just remember to explain in detail why you want the restraining order etc. God Speed and good luck

Call the police each time he threatens you and document it. I have a restraining order on my ex and it is for life. Until I decide (which I never will) to have it removed. I don't know what state you live in ( I live in Fla) but It is valid in every county in your state, no matter where you live, work, or play. More than likely the judge will issue you a temporary injunction (restraining order) until the matter is investigated and then issue a permanent one in about a months time. I must say however that he may get angry when he is served the temp injunction, so I recommend you stay to a friends, or family members house or a women's shelter until things are resolved. Best wishes and good luck.

you need to contact his first shirt, and explain what's going on. I'm not sure about the restraining order due to the fact he's not even in the same state. I would go to your local court building, and ask questions, lot's of questions...

Usually they will give you a temp. restraining order right off the bat then in about 30 days or so you will have to go to court to have it made permanent. If you have just cause then it can be made indefinite.

If you are living on base or near base, call JAG. The military court house. Also think about calling the chaplin or even his COC (chain of command) Make sure you get it taken car of before he comes back to your state. Keep your kids and yourself safe.

i believe it is different in all states on how long it will last ... when you get it (which you should if you dont feel you and your children are not safe) they will be able to talk to you about it ... i would not put it off either way.

You can file with your lawyer and they will most likely serve him in the military. But the best thing is have your lawyer contact his captain on this problen and I garentee he will put a stop to it.
