If there is no one in the car with a valid drivers license and the person without a license is behind the wheel, there can be a huge assumption that the unlicensed driver DROVE the car, parked it, and plans on driving it away.

Yes! If the keys are in the ignition they can be charged for DWL (driving without a license). The car does not even have to be turned on. That is true in the majority of jurisdictions.

Think about it, that license is to operate a vehicle. You were operating it, even if it was parked.
