They both have the same ethical and legal obligations, which are to aggressively represent their clients to the best of their abilities. The only difference is that the client of the prosecutor is the people or the state, and they bring lawsuits and prosecute based on evidence gathered by the police.

Ethical requirements vary by state. But, assuming ABA rules (which are the basis in most states)....

Both attorneys have the same general duties of candor before the court, not being allowed to lie or withhold information, both being required to provide legal support and avoid frivolous claims or defenses, both being required to notify the court of adverse precedent, etc.

The only real differences are in the confidentiality requirements -- because of mandatory disclosure required for prosecutors -- and in the way zealous representation is interpreted, with the defense attorney representing the client, but the prosecutor having a dual role of representing the state AND being committed to justice without any agenda.

Amen, tee.

Dude, you can't read a chapter or critically analyze what you read? Or are just too lazy?
