We are in a 12 month lease. In May, our landlord gave us a 30 day notice to move out. We told her she can't do that because we are on a lease. But we did say that we would start looking. Well, we found a place. If she tries to change her mind about us moving now, can we use her 30-day from May as official so that we won't be charged for the rest of the lease?

In California, a lease is a binding contract. In order to get out of a lease prior to the expiration, both parties must agree to terminate the contract.

You definitely have the upper hand in this one. Tell her that you will agree to terminate the lease if she doesn't charge you any additional rent after the day you move out.

And, get that in writing.

Of course you can use that she did serve it to you.I would ask her to put it in writting you are off the hook for the blance of the lease.
