So i borrow my friend car because my car was int he shop and he was gone to san fransico to visit his family and blah blah blah
so i was driving on Interstate 40 and i got cut off, spun out, rolled onto the median and the car is totalled
and hes suing me
first of all dude we're friends, second of all its YOUR fault

I am sorry to say, but if he drags you in the court, he would win. Not unless your insurance has already determined that it was not your fault. You could use that as your defense. Otherwise, i am afraid you have to pay him the money.

You drove it, you're responsible if his insurance denies coverage for it. If the insurance covers it, then he shouldn't be suing you...his insurance company should handle it.
You can try to recover from the person who caused the accident (the person who cut you off), if you can find him/her.
Have you offered to pay for the car?
PS-- You did borrow the car with his permission right? If not, then he could have you charged with theft- possibly grand theft.

You wrecked the car.
How is your accident your friend's fault?
If you are old enough to drive a car; you are old enough to accept the consequences of your actions.
As I see it; you have no defense.

You did borrow HIS car. You were driving the HIS car. He is without a car now. Is it his fault for loaning you HIS car? You wrecked HIS car. Replace HIS car. Pretty simple.

Pay him for his car, friendship does NOT mean you can destroy his car and not pay for it.
