i want sole custody of my child. The father and i were never married or anything and he has not seen the child in 7mo. nor has he attempted to give or send any child support what so ever. He does not live in the same state actually moved out of state away from the child but calls every two/three weeks to talk to the child. The child is a year old.

To get legal primary custody you would first need to legally establish paternity and then request primary custody and child support.

If what you are trying to do is cut off all contact between himself and the child, he could pursue paternity if he wants to be a part of the child's life and seek out visitation, but he will also be ordered to pay child support if paternity is established.

The Courts are going to be doing what is in the best interests of the child, and unless he has a documented history (arrest record) of subtance abuse and/or violence, the Court is not going to terminate a relationship between a parent and child just because you don't want him around anymore.

In most states, even if he wanted to give up all rights to visitation,If he is established as the biological father he would be ordered to pay child support until the child is of legal age. He is not required to pay child support until legal paternity has been established and a Court order for child support in place.

Even if he wanted to voluntarily sign off on all rights to the child, unless there is a new man in your life willing to adopt the child, most states will not terminate his rights once they are established.

And of course you've filed for child support and custody which will require a finding of paternity right?
