well about 1 month ago I ran into an old friend I gave him my number he gave me his. A couple of days later he called me for a ride home from work. So why not. That nigh he was arrested for 78 bags of herion. So after that I stop accocating with him.. a couple of weeks later im pulling into my drive way with my 6 month old girl 3 cops come up from behind say " Your under arrest" I say for what "they say for selling herion" " I ask to see the warrent thay wont show it to me" they search me and of course find nothing.. so they let me go...
1 week later DCF shows up with a statement from the cops accusing me of being a drug dealer. With no proof Ive never been arrested. But now I had to give my girl over to my parents or she would go into foster care while DCF does there 45 day Investication. DCF Says Im a risk factor becasue The cops made a statement saying IM a drug dealer. So thats what DCF thinks Guilty intill proving innocent.

So basically what I’m being told is that drug addicts/dealers can tell the cops other people are drug dealers and on their word its fine for the cops to call DCF With no other proof other than a drug addicts to go take your child.. And there’s nothing that can be done?

I don't think you would have a case, because the police are required to investigate associates, especially for a serious felony like your friend apparently committed (or at least was arrested for), and because DCF also has a responsibility to remove children from homes that might be dangerous, and that includes pending investigations.
It sucks if you happen to be innocent, but I suppose regulations like that are in place for a reason. I think you should contact DCF, because I'm sure they have a complaints division, and it would be good to go on the record as re-stating that you're innocent, that no drugs were found on you and you have no other record, etc. They will make that part of your file.

It sounds like a case of 'being at the wrong place at the wrong time.' In the eyes of the law, you are an automatic accomplice just because you had something to do with your friend. I don't know your past history, but if there is anything illegal connected to your past, this wouldn't help your cause any. If you are a good, clean citizen, the most you might get is harrassment, and even then, it's a stretch. Only way to win a defamation of character suit is if you are a good, clean decent citizen, and all the crap you are going through right now would ruin you in the eyes of the general public, preventing you from doing stuff like getting a job. But you would need to have solid proof to gain anything.

Against the cops, no. Maybe something for not having a warrant.

If your "friend" actually told the cops you were a dealer, you could sue him. If the cops were just following up all of the people he had called recently, you won't be able to do anything to him.

Generally speaking, you cannot sue police for defamation in the course of an investigation.

As for your friend, association with heroin dealers isn't good for anything (unless you are an addict).

I don't think you have any claim for defamation. They're investigating you.
