We recently signed a lease for an appartment. When we went to go look at the appartment we had the person showing us the appartment note that their were stains in the carpet. They are all over the place. This morning we called and asked to have the carpet replaced but instead they are telling us that we should try steam cleaning it. Should we have to pay for that? And do we have any rights to have the carpet replaced if we are not satisfied with it?

I've lived in many apts. I know how they do. If you want it clean you might as well do it yourself, they won't do anything to help you since you signed the lease as is. I know how you feel Good Luck! :)

If you've signed the lease, then you took the apartment in the condition that it was in at the time of the lease signing. The only thing is if they signed something stating that the carpets would be replaced.

I would clean it. If it doesn't come clean, then talk to them about replacing it. From their response that you've given here, it doesn't appear that they've ruled out that possibility. So, you may have a decent landlord.

You may not have rights to have the carpet replaced or cleaned at the landlord's expense unless your lease specifies.

Yes, the person showing your the apartment noted the carpet was stained; however, he/she may have assumed you were pointing out the stains to make sure that when you move out you aren't charged for cleaning the stains. (I was once charged $20 because I didn't clean the oven before I moved out of my apartment!)

No, tell the management or owner that they need to replace the carpet. Keep the documentation showing they noted the carpet had stains when you moved in. If they don't contact housing authorities.

No, you do not have rights to have the carpets replaced. You can ask about having them cleaned, but that is probably your responsiblity as well. Usually when you rent a place you rent it as it is during the walk-through. You can rent a cleaner from Lowes or from most grocery stores for about 30 bucks, with cleaner you are looking at 50 bucks.

Tell the landlord that you will move in for the advertised rent only if the carpet is replaced (at their expense), and that if it is not you will continue to look for another apartment.

If the really want you to move in, they will replace the carpet.
