Not in the U.S. Adultery is not grounds for annulment. You'll have to get a divorce.
EDITED TO ADD THIS:
It does not matter how long you've been married. Even if you're only been married a day, you still cannot get an annulment (and I assume you’re talking about a legal annulment, not a religious one) on the grounds of adultery.

Annulment grounds are limited to mental illness, fraud, forced consent, physical incapacity to consummate the marriage, lack of consent to underage marriage or bigamy. Even homosexuality is not grounds for annulment. I believe you will have to divorce.
My husband cheated on me but I was nice and got divorced on grounds of irreconcilable differences. In my more evil moments, I wish I had adultery put on the divorce certificate.

depends on how long you have been married..otherwise it's just a divorce..Go ahead and an annulment or divorce. You don't need to stay with this person
