That is called "preventive detention". However, if someone's offenses are bailable he can be out of jail by posting bail.

The legal and social principle is that if the evidence is sufficient, the party is either a flight risk to avoid prosecution. or a danger to themselves or society then they are incarcerated until proved other wise. As for bail this is at-large left to the discretion of the court to determine if bail is appropriate or not. The primary interest is that society/the people are to be protected.

u really can't be that dumb can u? u deserve to be locked up--if the person is arrested and cannot make bail (yes they are innocent until proven guilty) but depending on the problem they might be held in jail --- why so they can or will be brought to trial -- if you see someone breakin the law (shooting someone) and the cops come, u tell the cops u saw it -- should they just say -- okay see u in court, here's the date..

That's where bond comes in. If it is your first offense then there are some assumptions made and if it more than your first offense other assumptions are made regarding your flight status.
