Think about the question for a while... focusing on "lay claim to it". What does that mean exactly? Do you own the property your house sits on? ...or are you leasing it from your government? Miss a few tax payments and find out.
Why does this matter? It matters, because just as countries fought for unclaimed land centuries ago, if the moon was so important to being from another planet, then we'd of course have to fight for it.
Our ability to lay claim would be no more valuable than our ability to defend against take over... and if a alien species were so far advanced to travel solar systems, we'd be SCREWED.
Thus, you should be worried about them laying claim (or invading) our own planet... not the moon... which is a dead rock floating in space no more valuable than any other piece of ice or dirt floating through space.
...and when it comes down to it, it's our WATER that probably ends up being the most valuable resource of all.

Well I guess this question is not for me since I do not believe any of that.
There are no aliens stopping us from setting up a base on the Moon. But the U.S. has signed the outer space treaty which forbids any government from claiming the Moon, or any celestial body.
