My brother just started a new job. Now, the 1st paycheck that he received from his employer bounced, when he tried to cash the check with his bank. (BTW his bank is Golden One if that makes any difference.) The 2nd paycheck cashed fine. Now he tried to cash the 3rd paycheck and it bounced!
* Is there anything my brother can do to receive his money?
* Is there anything he can do to prevent his employer's checks from bouncing?
* Are there any "legal" actions that my brother NEEDS to take, against his employer?

(NOTE: Please don't leave any SARCASTIC answers!!! Cause this is kinda a serious matter. I don't think you would be too thrilled if 2 of your paychecks came back BOUNCED!)

BTW His boss/supervisor told him to talk to the business owner. My brother lives in Sacramento, CA. While the owner lives in Fremont, CA. And his boss basically told him, "I can't do anything you need to talk to the owner."

* So what if the owner says, "there's nothing i can do about that either"? What does my brother do then?

Best bet is to call the labor board. Also you could take the check to a bank where the account is held to make sure it will not bounce, and that way your bro won't be stuck with the bounced fees at his bank. And make sure he gets cash from their bank.
He should find a new job ASAP. It sounds like his company is going under.

Go to WWW.labor.ca.gov. to get a form for help from the labor board. Good luck. I hope this helps

Doyou have a State Department of Labor? If so, your brother needs to contact them and file a report. Most states have laws which permit that department or one like it to make demand on the employer for the money. If he doesn't, he's engaging in a fraudulent practice and his business license can wind up in the shredder.
He also needs to find a different employer. This one sounds really shady.

Bouncing paychecks is a really REALLY bad sign.

I'd start looking for other work immediately, and try to cash the check at work from the cash drawer. If that doesn't work, go to the bank it's drawn on and try to submit it "for collection", which means they hold it until there's enough to pay it, and you get paid.

The first thing he needs to do is quit. Paycheck bouncing will not magically go away. If it's a large sum of money, he then needs to get a lawyer. It's a cut and dry case, and shouldn't involve an actual court case.

A business that my father worked for was having trouble making its payroll, and one of the workers put a workman's lien on it. The sheriff padlocked all of the entrances until the worker's claim was satisfied.

Before taking such drastic action, though, your brother should talk to someone in the payroll office to find out what's going on. The company may be going under, in which case he needs to be looking for another job.

Well the most logical thing to do is talk to the employer....You haven't said anything about him talking to the employer.

If you try to file a suit they'll tell you the same thing
