Can a 14 year old in NY state legally change her last name to her stepfather's name? Biological father is not dead and all parents have consent. If so, what is the legal action that needs to be taken and if not, how old until that person can legally change?

First consult a lawyer specializing in civil matters. The lawyer will tell you the procedure involved and will make sure you get it done as quickly and correctly.

Most states require that a form is filed at the courthouse in your county of residence and that notice of the name change is published in the county's newspaper of record (not necessarily the one with the largest circulation). Publication has to run for a set number of days, then you go before the judge who will authorize the name change.

Again, consult a lawyer. I have no experience with New York law and it may be different than my home state.

You have to get a petition for name change, from a lawyer or your local courthouse. Fill out these papers and file them at your courthouse. You must have notified both parents of the name change. You will be assigned a date to see the judge, who will look over your application and, if all the info is there, will almost certainly grant your name change by signing the court order. Voila! The name is changed.
