Capital murder is a shorthand way of referring to any type of murder that may carry a capital (death penalty) sentence in the appropriate jurisdiction.

What specific types of murder qualify would depend on the country and state/province. For example, in some states murder during kidnapping or rape may be a capital offense, but in other states only premeditated murder might qualify. Check your local listings.

In my state, there is no such thing as first or second degree murder; capital murder is the most serious and can get the offender the needle in the arm.
