i work as a lifeguard and get paid hourly. And i was just wondering if we were spose to get overtime cuz last year at this other company i got paid overtime for life guarding. someone tomld me it was like agianst the law or something.

There are some exceptions to overtime rules, and seasonal employees are one of them- but maybe they'd pay you better if you learned to spell.

There are some exceptions to the requirements to pay overtime, but it is extremely unlikely that you meet any of those, whether you are paid hourly or salaried - and most lifeguards would be paid hourly.

Your employer is required to pay you time and a half for hours over 40 a week. They can define any 168 consecutive hour period as the "week" for their business, but it has to stay constant. They could, for example, define the workweek as Friday noon until Friday noon the next week.

There is no requirement to pay overtime for hours over 8 in a day.

If you are an hourly employee, it is illegal to not pay you for overtime (anything over 40 hours/wk). If you are salaried, then you are out of luck. The labor laws should be posted in a visible place for all employees to be able to reference at any time (typically in the locker room/break room).

Visit www.dol.gov and view the wage and hour laws for yoru industry. In most cases, employees who work more than 40 hours in a pay period (and sometimes more than 8 hours in a day) are entitled to 1.5x their normal rate of pay for those hours.

There are different laws that apply to minors and to certain industries, so you do need to check the Dept of Labor website. Good luck.

yea you prob fall under the exception rule with the life guarding thing, because one of the rules is the number of employees you got working for you could disqualify you from the federal laws that one of the other Answers talks aboutl.
