My daughter was with a friend at the store. Her friend asked her to add up all her merchandise when finished they paid for the items. Before leaving Security approached them and said "come back with me" When asked why they had to go with him he replied we believe that you did not pay full price for the item. He than asked if he could check their purse, my daughter and her friend willingly let him. My daughter was unaware what he meant because both children had receipts and nothing was found on their person. To make a long story short they told my daughter she was on tape hovering over her friend who was switching price for the item this leads back to where she said we were standing close when I was adding up her item i was not with her when she was in the jwelrey section. When my husband went to the store he asked if he can view the tape and they said "no". When am I able to view the tape? And what happens to her if they say it looks but aren't sure of her covering the accused thief?

IF you daughter is charged with a crime, the defense has the right to view ALL evidence in the case. ANY tape would qualify as evidence. Unless she is charged, you have no reason to know if there is even a camera pointed at the part of the store in question.

NOTE: up to 75% of the camera domes in many stores are EMPTY. When I worked in retail, part of my job was moving the cameras every month.

The first question is was your daughter given any sort of citation or order to appear in court or anything like that? If she isn't charged with anything, well, there isn't much you will need to do. A lot of times, they try to scare kids into ratting out their friends by telling them stuff like that when they really have no actual evidence of anything to charge the kid with. Especially when they get the parents involved because the parents will push their kids to turn on a friend even if they really didn't see anything.

If your child has been charged with something or summoned to court, then you should consult with a lawyer (some will consult for free, others will charge a small fee). You make an appointment and go in and tell them what's going on. They can give you their opinion as to the best way to precede and if you like what they say, you pay a retainer and then they will handle things. There are also court appointed attorneys if your child has been charged and you can't afford a lawyer for her.

Were they arrested? If not, you don't have a right to see the tape. Stores are private property and if the just banned her from the store then you have no recourse. You probably just need to forget it and move on.

1. you have the right to review any evidence against your child
2. the store has to charge your child with shoplifting, which they have no proof of even with "hovering". (i know, Wal-mart once tried to convict me of "accessory to shoplifting" until they found out there was no such thing and I wasn't even with the person they claimed I was helping).
3. for the best advice, get a lawyer.
4. if there was a parent or adult with them, the store should have gotten you before searching your child.

accuse the store security of abusing you daughter and then subpoena the tape as evidence

You can indite a ham sandwich...getting it convicted is another story

Go consult a lawyer they love false accusation cases

I think you should view the tape anyway or call the police
