Can you put it in the contract that the sale is contingent upon a clear and free title instead?

Yes, here's why. Last year my sister n law purchased a townhouse in Florida. This past week she was notified by the county the some tax was delinquent and accuring interest and penalties. She doesn't remember purchasing title insurance. It could cost her. So I would recommend it highly.

Yes, because you never know who or what can come out of the wood work and claim title to your property. You can shop around for a good price or have the seller pay for it.
