Take the equivelent of your half of the check out of a joint account (if possible) and then hand the check over to him. If he wants the money, then he has to sign it and cash it himself. If you are beyond that in the divorce, make it part of the settlement with your attorney. You will get it no matter what, it will just take longer if it has to go through the settlement. Tell him that too, he may just sign it to get it over with.

I would open a savings account and wait a day or two then have a friend sign his name and then deposit it into the account. If your name is not on the account have it indorsed to you and cash it, you are still legally married and it is yours as much his.

Go to the bank together and split the money right at the window if he is worried about not getting his half.
