He says that because he wasn't "with" her till after he moved out and I can't prove otherwise, that they courts won't consider it adultery. He hasn't filed anything yet but has had a lawyer on contingency. (btw, she's pregnant and they're both sure it's his)

He also says that because we the home we are in isn't martial property that he doesn't have to provide me with a place to live. That he can take our daughter into his home and leave my shelter in my hands to deal with even though I haven't got a job.

We live in TN.

Just a couple of thoughts:

how far along is she? That could be the proof you need. If he moved out of the marital home directly into her house... the courts are not stupid they can put 2 and 2 together, but sometimes you have to point it out to them.

If you are going to file for divorce and you believe there was adultery then put it in the court papers and have him prove it did not happen.

If he was the primary income earner and you stayed home to raise the kids the courts will find in your favor, and award you alimony, based on a lot of factors, including how many years you were married. On top of that you will get child support, and the court will give you primary custody unless he can PROVE you to be unfit.

Get a lawyer. He is intimidating you. And because you are unknowledgable about the law you are feeling scared.

You have more rights than you know, and it is adultery if the divorce isn't final.

Unless you are an unfit Mom, you'll probably get to keep your child. So don't listen to him he is just bullying you.

He can't take your daughter without a custody agreement, negotiated with a mediator or a judge. He may have to pay child support and spousal support, but that depends on getting a good lawyer. GET A LAWYER!

if you aren't LEGALLY divorced, and they were in a relationship, it's adultery. you have to be divorced on paper, not just separated. it's even better that she's pregnant. get a DNA test, and a timeline for the pregnancy. be happy you are rid of that scumbag.

get a lawyer. and a job.

He can not take your child from you unless he could prove you are unfit. If you were stay at home mom that looks good in your favor because you are her primary caregiver. He is talking crazy because he wants to upset you. You can prove he had an affair while you are married because he was stupid enough to knock her up. Be thankful you are not with him because he seems trifling.

it really is not going to matter about the adultry. and if he bought the house before the marriage, it is not marital property. HOWEVER you are entitled to half of the appreciatoin of the home that happend during the marriage (esp if it was due to improvments that you made to the home) also you get a portion of whatever payments have been made to the home while you two were marreid.
