Ok, I rented a car from Rent-a-wreck, ha, cuz I had to get my car fixed. While I was driving the rental, I drove over a manhole during a heavy thunderstorm. I was going 5 mph, cuz I just pulled out of a driveway. Well, I drove over the manhole and my airbags deployed and the front windshiled shattered. Lucky me. I had my 3 month old son in the car, but we are both ok. I did not call the cops that night .So the next day I called rent-a-wreck and thay came and towed the car and I filed a report . I got car insurance from them but I still had to pay like a 750.00 deductible plus towing charges. insane. The manager of rent-a-wreck said the damage was about 4,000.00 cuz it messed up the whole underbed or something. I need to get my money back! The manhole cover was in a neigborhood doing construction so it was popping up a lot. again it was raining. The road is still a private road and I want to see if I can sue the developer for the cost of the damage since the manhole messed up the car.

I had to file a small claims case again my car insurance company one time. The easiest way to do so was to go to the website below and follow the instructions. Yes, you can file a small claims suit for less money, but this was a really easy way to fill out all of the paperwork without the need to go down to the courthouse.

You will need proof that you tried to recover your damages from the developer or whomever you are suing for the money. A letter to them demanding they pay you for the damages is fine, then file at legal zoom and your on your way!

You can contact the county courthouse and ask them what forms, cost, etc. However, when you go to court you will need PROOF that the developer was negligent.

Can you prove the developer caused the manhole cover to be open? Or that this had been an ongoing problem he was aware of? That will be very difficult to do.

Go to your county clerks office, file the complaint forms. Pay the summons fees and show up on the court date armed with pictures, witnesses, bills etc. Good Luck.
