a year ago i was arrested for shoplifting. however, my lawyer was able to bring the charge down to trespassing misdemeanor. this worries me a lot, as three days from now i will be having a big interview for this company that requires an extensive background check. ive prepared myself for everything except for this. what do i say if the subject of my arrest comes up? should i give every detail about what happened? i need your advice guys. also, what do you think will the company see on my record, is it the trespassing or shopifting?

Please listen to me! I used to be the Staffing Manger of an investment bank with 90 branch offices. We did very extensive background checks on everyone, even fingerprinting.

Your background check should show the misdemeanor trespassing. (If you are unsure, you can visit a variety of websites that will let you pull up the info, for a fee-- I highly recommend this because then you will be confident of the info they will get).

The application typically asks if you have been convicted of a felony. Most companies do not hire people with a felony.

You do need to disclose the offense before they run the background check. (You will most likely complete a form authorizing a background check to be performed.) A misdemeanor offense will not disqualify you from the job. You will be asked to explain and based on your words, it will be decided. I suggest keeping the explanation very short. You do not need to disclose the entire situation. Do not tell them that this a lesser charge. Stick with the tresspassing story. Since you have this blemish on your record, they are more likely to choose a different candidate. You need to really stand out in your interview to get this. Honesty will definately help. OK, so if asked about convictions, say you do have a misdemeanor trespassing conviction. The explanation is, "I was somewhere where I wasn't supposed to be and got caught." Be as specifically evasive as possible without telling an outright lie.

If asked about felony convictions, the answer is, "No! Of course not!"

I can't remember ever being asked about any criminal background for any job interview I had, however there are sometimes questions about it on the application. If the questions were on the application, and if you answered honestly, they will probably ask for details. Just tell the truth. Say that a year ago you did something really stupid and stole something, that you did x (whatever it was for punishment), and that you learned a valuable lesson in honesty verses dishonesty.

Nexus/Lexis is a private data base so you have no criminal record you have a file used by subscribers not all employers are subscribers. It is more important in the interview to be honest then to sweat what they know do not know. Liars always loose (at least should) being honest may not get you the job but if you have self respect and respect for others never lie

I would call ur lawyer and ask. This is gonna be something that you need to handle at every interview.

Did they specifically ask for misdemeanor on the job application? If not, don't mention them!

It's good that you're making an effort to try and change your past. Most times, employers will value honesty, and if you have the guts to be upfront and honest about it, and demonstrate the will to change, the employer will commend you for that. You definitely won't get the job if your employer digs up that dirt on you without you having first confessed to it. I hope all goes well for you and I hope you get the job!

If you mention the shoplifting, you won't get hired. Hopefully potential employers are only interested in felonies.

If you pleaded to trespassing that's what the background check will show.

How many years ago has it been? That is an extremely important fact to know.

I HAVE NOO SYMPATHY for you, you should have thought about it before you shoplifted, oh well..looks like your not getting that job! life sucks, and doing stupid things require consequences...

...think about what might happen b 4 u go and do something stupid!
