Check with your local property ordinances people. Most places will want you to ask your neighbor to do it first. If the neighbors don't want or unable to do the cutting, you probably have a right to cut them yourself as long as it doesn't kill the tree or do other damages to the neighbors property.

WOW. Touchy subject. I could fill this page with the problems that I have had with a neighbor's tree. I will spare you the details.
But, I have learned that the tree parts that are hanging over your property line are yours. You can cut them. However, there has to be a good reason. If you do it for some malicious reason and the tree dies then the neighbor can sue you for damages.
It would be so nice to talk to the neighbor and discuss the problem with him/her. If they are good neighbors they will see the problem and help you out. My NEW neighbor is like that. We agreed to split the cost of the trimming and had a professional trim the tree. The tree is about 30-35 feet tall and is planted about 6-8' from the corner of my house. I was having to clean the gutters at least 6 times a year. Plus the pine sap was getting on the hot tub cover and the patio furniture too. I had to use acetone to get it off.
Sorry, I was going to spare you the details.
That was my experience with the hanging trees. Hope things work out for you. The law is a little fuzzy on the details and lawyers don't want to get involved in neighbor disputes.

In our municipality, the owner of the tree is under no obligation to prune anything hanging over your property....as long as he's not running into utility lines. However, because it is encroaching on your property, you have the right to hire someone to chop every part of the tree that is on your side of the fence.
There would be two exceptions to this ~ 1) if the tree was some sort of protected or endangered species in your city or 2) if the tree was in the public right-of-way and actually belonged to the city.
Before chopping anything away, call your City Forester or City Hall and get the OK.

Depends on where you live. In most towns in Missouri you can ask your neighbor to cut the limbs over your property line and if they don't you have the right to do it. May make for angry neighbors which is the chance you have to take. My experience is if the neighbor is a good neighbor they'll let you trim the tree (at your expense of course). If the neighbor is a jerk, go ahead and trim the tree; you haven't lost anything.

Yeah get him to cut the branches that cross on your side. If not go to city hall to request to have it removed.

cant force them to do anything.. its not his fault they grew this way. you are allowed to have the branches cut. but you must do it right.. you cant just go and hack them off. and its your bill. now if the tree is in bad shape you can force them to remove it. you will need to have an expert out to confirm it then try through county/local health dept or through court.
