If I file a workers compensation claim and I decide this job is to much for is the employeer still responsible for paying for medical care after I leave. Like this is my second claim I had surgery on the first one and just had to file another one. I just begun to go to the doctor but I seriously want to find something not so hard on my body. Will workers compenstaion still pay or should I consult an attorney.

The company has to find you suitable work. The doctors confirm any restrictions of duty. If that does not sute your needs, then you have the right to consult another doctor. Workmans comp will usually settle a $$ amount for damages, if you can find another doctor to confirm your restriction of duty. Don't take their 1st low ball. Most lawyers do not like to go up against workmans comp., but there are some lawyers out there that specifically work those type of cases. Google the bar association and check some out.
I had cut the tendon in my finger at work. 3 months on codine and healing had left me weak. I could not do the duty I was asked to perform. I tried it for 4 days. I should have told them my back was hurt (muscle strain), but I simply said that I could not do it. They told me to go and try it. I said I had tried it for 4 days and I cannot keep up. They said I was fired for disobeying an order. Well, I got unemployment anyway. I didn't try to sue them, because it was in Oct of 2001. My finger did finally heal. But my dexterity is not what it was. I got a better ad easier job anyway. Take your unemployment and get you something better. If there is a lawsuit opportunity, you have time to persue it.
