His wife and MIL are heavy drinkers, to the tune of $400 a month at the liquor store. He has been kicked out of the house, for not buying their liquor anymore. His two kids are still there. They are 2 years and 7 months old. He wants to get them out of there, but needs to know how he can. He's got to prove they're behavior is bad for the kids. They leave open containers of alcohol around and MIL mixes it with Kool-Aid. We're afraid kids will get it. Can anyone help with this?

I would call CPS and get them to do a surprise visit. Can he get his hands on bank account statements (maybe from a joint account) that show the purchases at the liquor store? Any friends or relatives that can confirm things with CPS?

Another thing to think about is that since no one has court ordered custody of the kids, each parent has equal say. If he can con the mother into letting him have the kids for a visit, he does not have to bring them back. He should let the mother see the kids (and make sure he has adequate places for them to sleep and such), to not do so is against the law in most states. But he does not have to let her take the kids anywhere. The catch is that he cannot leave the kids with anyone else. No one but him has the legal right to keep the mother from taking her kids. My hubby did this with his ex wife and it worked.

I tried to prove my ex did drugs and it backfired. He is back on them now and the court wouldn't listen to me. I have to let my three kids go with him every other weekend and there is nothing I can do. You have to catch people off guard and I would call CPS if I were you. I can't for mine becuase I don't think my ex does it in his home. You could just call CPS and they would walk in unexpectadly and find open alcohol containers lying around. That should do the trick.

He needs to hire an attorney and perhaps a private investigator. Tell him to act quick before the kids lives are in danger.
