A couple nights ago I heard a noise in my ceiling and my husband went into our kitchen to get a drink and a rat jumpedout at him. We dont live on the greatest end of town, but we are very clean infact my husband is OCD. Of course we grew concerned and called our landloard,and she said " I would advice you to buy a mouse trap". Is this legal? Isnt she responsible for maintaining all health codes? I would say this is a health issue.
Also, our lease is up in September, so if we don't fix the problem and move out of this discusting house can she keep my deposit?

Now wait a minute-it isn't a bad landlord to ask you to put out traps or bait. How do you think you get rid of rodents? How did they get in there in the first place? If you call a professional, that's about all they do. Rats come in when the weather is bad or there is food available to them or both. If you live in a place where there are rats, they will try to come in. What did you expect? Your landlord cannot control rodents. Just go look around outside, find where they are getting in, and put some poisen out but be sure there are no pets or children that can get to it. How hard is that? Oh boo hoo, I live in a bad part of town and there are rats outside and one came in. Rats aren't that stupid. They like easier living too. Do something yourself. . .Your landlord can't play a fife and all the rodents in town will follow them out. Check your dryer vent and see if they haven't walked in that and look up because they like to come in from high places and stop them before they seriously infest the place. Do not leave pet food or bird seed around. Put every bit of food that a rat can chew into in your fridg. If you have an access to your attic, throw some poisen bars up there. Ask your neighbors not to leave edibles around either. Your landlord has no control over rodents trying to get in. But I do think your landlord should provide the poisen and traps but you need to make an effort too. The rat wasn't there when you moved in. . .

I would read over your lease with a magnifying glass just to make sure your reading all the fine print. Then if it does say something (which it should) about your landlord taking care of the problem then call and make someone do something. If they don't do anything somewhere on line you can go find a document for your state about the "tenant, landlord protection act." Every state has it's own laws to protect tenants from landlords. I wouldn't put it past them to try and keep your deposit either. There's no real proof so far that you tried to fix the problem and if you don't have proof and you move out and they keep your deposit there's no fighting chance you'll get it back.

It depends on your lease terms but as long as there is no damage caused by you, they can't keep your deposit under normal circumstances.
