how to go about lowering your child support payments in the state of Ohio? When the support order was issued (2 years ago) I was making more money than I am now and now I have a new baby with my current girlfriend. I don't even bring in enough money now to make my monthly bills so hiring an attorney is out of the question as it will just be another expense. I'm not trying to get out of paying for my kids, but I can't even afford anything at this point. As of now I am paying $780 per month and my ex makes more money than I do. I don't understand why I should pay so much when I have my children almost half the time she does. They have their own clothes, personal items, toys, that I purchase for them when they are with me. I would really appreciate any advice from people who have been in this situation such as how long it took, how hard it was, etc.. Please no nasty comments about me not taking care of my children.

She is not the custodial parent. We have shared parenting and she is considered the residential parent for school purposes only as it is stated in our divorce papers.

Yadda, yadda, yadda.

What makes you think that just because you made the decision to take on more debt, have another child and have more financial responsiblilities releases you in anyway from supporting your children?

Do you really think the courts or anyone else gives a hoot about your financial problems? It is your CHILDREN the courts care about. If you don't have enough money, then get a second job.

And, unless the children spend exactly 1/2 of the year with you, you are NOT a shared custody parent. It makes no difference what your divorce decree says.....if the children live with the ex for more than 6 months during the year, SHE has custody....and you must support them.

Perhaps you should have thought of the additional debt BEFORE you decided to have unprotected sex with another woman and bring another child under your debt umbrella..

The only way you'll get this changed is if you do hire a lawyer. They can draw up papers saying you do not make as much as you did. I know in Texas this amount can be changed every 3 years, as far as Ohio, I am not sure. I'd call the attorney generals office and explain the situation to you, but honestly a lawyer is the only route in this instance. Good luck to you.

Hire an attorney. However, I caution you that judges RARELY lower child support payments. You probably don't have a chance at all unless the court finds that the original order for support was outrageous.

If you are in Ohio, you are pretty much screwed. There are too many ways for the custodial parent to shaft the non-custodial parent. It is liberal politics at its best.
