You are so right, cannot believe most of the answers to your question. They all should read more and be better informed before calling you a fool, they are the foolish ones believing America and GW is following the Constitution. Our founding fathers would turn over in their graves if they could see America now. Bush really lost the election but was elected anyway. Feel he will go down in history as the wost president ever for America. But when he climbed the mountain in Colorado and spoke with God he became a born again Christian, God told him go to war with Iraq to kill over 700,000 Iraqis and look at all our brave troops lost and the wounded. Time to wake up America...

Every President from Lincoln on has been doing this. Since his actions have precedent, I don't see his actions being near as bad as some of the others such as Lincoln, Nixon, Johnson, Clinton, Wilson, and FDR. We the people really need to get serious and elect people who fully believe in the Constitution rather then the book of Marx and radically decrease the size and scope of the federal government.

Pirate: the protector of the people are "these united states" but they can no longer check the size of the federal government because of the 14th Amendment - this Amendment also empowered the Supreme Court over state courts setting up much of the current problems. Before the 14th, State Supreme Courts were higher or at worst equal to the US Supreme Court.

First, I urge you to read the constitution -- in its entirety.

You can't judge the acts of the president in relation to the constitution, nor his powers, nor those of congress . . . for that matter, without having completely read (and understood) the constitution.

I am far from a Bush supporter. I am far from a republican, a militant, a terrorist . . . I am far from pro-war . . . but I'm definitely pro-constitution, and I'll tell you this much.

It's misleading to believe that only legislatures have the ability to make laws. Do you know what an administrative agency is? The FDA is an administrative agency. . . they are organizations created by the president or congress with authority to create rules and regulations (in short, laws). . . the administrative branch creating laws . . . what's that? How about an executive order. That's a law . . . it bypasses congress -- but it's a law -- those come from the president -- or, what about common law? That's judicial in nature.

While the legislature writes the statutes, the judicial and executive branch makes law as much, if not more than the legislature.

So, I'll answer each of your questions systematically -- having explained the sources of law and the need to read the U.S. Constitution (particularly before declaring acts against it).

No.

Every president who is president during war-time, at one point or another, has had his behavior questioned. Do you know why he's president? Because . . . we the people (or . . . more accurately, we the electoral college . . . decided that he would be the best at the job).

*Has presidential power been overstated and manipulated by his claimed authority?*
Nope -- again, check the constitution for the limitations placed upon him . . . .

*Why isn't congress protecting the American people and the constitution from being destroyed?*
The constitution isn't being destroyed -- and. . . have you written your representatives and senators? If you feel their not doing their jobs . . . take your beef to them.

*How much longer are the American people and congress going to be intimidated and controlled by this misconduct?*
Well -- those are pretty strong words -- accusing the president of misconduct, while not directly stating claims against him . . . and as to the first part of the question . . . my guess is . . . until we elect a new president.

I urge you to check the district court decisions for cases against Ashcraft -- you'll see accountability is still in existence.

*Is this unchecked power going to go on unchallenged by the American people and congress?*
Unchecked power? What -- the ability to direct the armed forces -- as enumerated in the constitution . . . or the ability to establish executive orders? To which unchecked powers, specifically, are you referring?

*Is congress failing to protect us by ignoring the constitution?*
Wow. . . you've really not read the constitution.

*Is congress a willing partner in failing to protect the constitution and not living up to its oath of office?*
Well, I'm going to say that . . . with the president being republican, and the majority of congress being democrat -- they (the majority) want for nothing more than to hate the president, and an excuse to get rid of him. . . so, I doubt the senators and representatives are a willing partner.

*Will our democracy survive this attack on our constitution?*
Well -- it's survived denigration through the centuries by idiots, so I expect it will survive this, too.

*What are we willing to do to protect our country and constitution and people against this attack?*
First, tell you that when you make a list of things, you can use the nifty "," to separate them. . . rather than using and, repeatedly . . . then, tell you again, that it seems as though your post (and mine, as well) has fallen upon deaf ears. . . write your representatives -- you put them there -- if you don't like their actions -- tell them about it.

I hope it goes to school before it tries to take over.

Why aren't you listing the constitutional rights that you have been denied, you poor liberal??? Liberals know that their rights have not been taken away. It all goes back to their intense hatred of Bush. That is what has led to the liberal's sympathy for terror suspects who tried to kill our troops or attack our country, which is pretty much what they're talking about when they're whining and crying that their constitutional rights have been taken away. Their hatred of Bush has led to their wanting the US to fail in the war on terror. It's a bunch of garbage. They need to get over this whole Bush thing. They've turned anti-American, and that is the main reason why I believe a Republican will win again in 08. The liberals sound very dangerous and anti-American.

Any president who goes to war without congress declaring war is violating the constitution. A good example would be John F. Kennedy who led us into war in Vietnam. Thank God Richard Nixon got us out of that one.

Here's the beauty of what he does. He uses fear to gain power. The shear fact that he's abusing the law is not intimidating, your question is proof of this. But the problem is that he simply cheats, but what grounds are these for impeachment...after all he is a good Christian man with wonderful Christian values, and no Monica

P.S. the judiciary branch is responsible for enforcing the constitution.

I am not a George Bush supporter, having said that I believe the checks and balances contained in your constitution, and political system would not allow any president to either Violate, or destroy your constitution.

That is my Canadian opinion.
