I was riding my bike down a busy road on the sidewalk. The road has side streets where you have to stop at the stop sign, then proceed. Well I am coming to an intersection and I see the driver pull up to the stop sign. I slow down to see if he will let me pass. It was sunny so I couldn't see the driver but since he stopped so suddenly at the intersection I thought that he was letting me go. So, I proceed into the intersection and all of the sudden he gasses it sending me over the hood of his car and I end up in the street. I quickly got up and I was fine. My bike was okay too. The driver just sat in his car saying profainities under his breath and NOT even asking me if I was alright. He was so worried about his damn car, so he gets out and is looking at the damage (which is a few scrapes around the bumper and the headlight) and I apologize and he gets back into his car and leaves. I live in New York and I know that the pedestrian has the right of way, but was this my fault or his?

No, I didn't have a stop sign. The road I was riding on has no stops at all.

My sister is 16 and she can't even drive on a highway and she got 94/100! Can you believe that?! Well... that's how screwed up Nevada is...! Some driver licenses are fake... One of her friends used to have one... I saw your other question so I didn't really read this one (us kids are so lazy these days...). Sorry!

First, you are not a pedestrian, you are a vehicle. In some states you can be cited for riding on sidewalks. The big question is: did you run a stop sign? If you ran the sign, it looks like it is your fault. If you did not have a stop, it looks like him.

on a bike, you are the same as a vehicle. if you had no stop sign, he is in the wrong. you were not on the sidewalk when he hit you,so it doesn't matter. the same thing happened to my son, only the gal broke the bike,and i made her buy him a new one.

Doesn't sound like it! Sounds to me like ya should of called the cops and had him ticketed!! Kids these days have NO manners!!!
