my girlfriend's mom is moving out to get away from her husband. But they have lived in the house for 7years and her mom and step dad have been spliting the house payments over that time. Her mom wants to sell the house and split the money down the middle but her step dad is intent on staying in the house and not selling.

Is it possible for her to get some if not all of that money back that she has paid over the last 7yrs, since the house is in both their names?

Also they are not legally marrieds, but had more of a veitnamese serimonial marrage. So more or less like roommates.

Possibly, the courts can order that he buy her out by paying her half the equity in the house. She will need an attorney.

She will not be able to get past mortgage payments back but if he wants the house, he will either have to buy her half out or sell the house and give her the money that way.

if her name is on the deed then yes she is entitled to half the value of that house they can either sell the house ans split the money or he can buy her half from him,

if she isn't on the deed and doesn't have any common law rights she gets nothing

No, there is no way she is entitled to get any money back. She lived there. If he doesn't want to move then he will have to buy her out of her half of what the house is worth now.

If the deed is in her name, she can sell her interest in some states; she needs to take the mortgage and deed to a real estate atty who can advise.

Probably should see a lawyer about this. Sounds like this could be very messy.
