They are supposed to treat you with respect, but as with many other state or government employees high up in the political field, they can and they do and yes they will and do get away with it. It's called abuse of power.

Generally, yes they can -- but most tend to be reasonable and respectful unless they have a reason to be upset.

The reason you cannot speak back is because the judge sitting on the bench is not just a person.

A private individual does not represent anyone other then themself. An attorney represents the client.

But the judge, while on the bench, represents the entire court -- and insulting the judge is an insult to the court. Which is why insulting a judge on th bench is grounds for contempt of court.

Speaking to a judge at any other time, such as on the street, is a different matter. They might get upset, but they cannot cite you for contempt.

A Judge has free reign from the bench. He doesn't have to be polite or sensitive or anything else.

Most judges tell it like it is. If you are the one being "dressed down", your best bet is to keep your mouth shut and take it like a man. If you spout off, you can be charged with contempt of court and thrown in jail.

Judges courtroom, Judges rules.

During the actual case itself the judge's speech is fully protected.

Outside of court they are fair game just like anyone else.

I am sorry if the judge was rude to you, it happens and even the best of us have a bad day. The only way to respond to them is to report them to the other judges, but since their power is pretty absolute it won't do a lot of good.

I am a bail agent in central california...that said, I have seen numerous court proceedings. They can and DO speak how ever they feel to defendants, attorney's and other court personnel.
Judges are given a lot of power, sentence people to YEARs of prison, community service and other things. Outside of being flat out discriminatory (even that might slide!) they can tear you a new one and not even get a phone call telling them to tone it down.
If you think you're going to get even and talk to that judge outside of the courtroom...be prepared to be arrested/harassed and have your life be messed with in ways you never imagined.
Advice...: Just let it Go....... As far as responding to them..."yes judge/your honor." Period.

A judge shouldn't speak rudely, regardless. Doubt there is much you could do about it without many others lodging the same complaint.

Contact an attorney that is NOT in the same county as that judge and inquire. Many attorney's are "buddies" with the judges that they work with daily...

While a judge may not subject to the same contempt charges for disrespectful actions in court, they are not immune from action being taken against them. Many, if not most states have procedures in place for filing complaints against judges.

They can say just about anything to you. I got so nervous one night when I was stopped by the police, that I couldn't find my car insurance. When I got to court, the judge called me a stupid idiot for not bringing the insurance for the car I was driving that day, I had brought the insurance for the car that I got the tickect for. You just keep your mouth shut or you could be in for a lot more trouble.

It's considered their courtroom. With their runaway egos and their power to throw your sorry butt in jail, I would not recommend giving them doses of their own attitude. You can't win! You'll be writing your next Yahoo question on a laptop from jail, where you are sitting in contempt of court.
