my husband is fighting custody for his little girls and his attorney pretty much took the money and ran with it what can be done about this ? can he file a case against the attorney or what? this attorney has been turned in to the board 13 times ...what can we do?

If your attorney fails to show up for a court date, you explain the situation to the judge, and ask the judge for time to obtain new counsel. That request will almost invariably be granted.

While filing a complaint against the attorney may help you in the long run, your first priority and your focus should be the custody battle. You have time to deal with the attorney later... and the judge may file an independent complaint or seek sanctions against the attorney as well.

If the attorney has 13 ethical complaints.... that might be a hint that he's not a very good attorney.

But other than firing him and reporting him a 14th time, the only thing you could do is ask the judge to impose sanctions against your own attorney -- which would be fun to watch.

You sue for malpractice! Also, you file a complaint with the state Bar Association. GET ANOTHER ATTORNEY NOW. The other attorney will advise you on how to proceed.

First of all, he has violated alot of ethic statutes .

Call your state bar and file malpractice.
