I was convicted of simple possession charge of marijuana when I was 15 but my license was suspended because of it and now I'm 18 and it's on my driving record. Here in SC your juvenile record is confidential but it's still on my driving record. Can I get rid of it off my driving record? If I was to go to college would I have to tell them I have a criminal record just because of my driving record or are those two different things?

hey .. u was convicted which means u had received your punishment for that .. your future is surely different from the past. You don't need to disclose anything which is unnecessary. If they want to know further unrelated information about u , they should do their own search. You have a right not to disclose what is not necessary ..

Not quite. You MUST tell the college that you have a drug conviction, even though it was as a juvenile. NOT all things are sealed when you turn 18. You will not qualify for any federal financial aid because of your drug conviction. You cannot get around that. It will come off of your driving record in time (whatever the expiration period is). There is nothing you can do about that. However, you MUST disclose your drug conviction to any college/university that you apply to WHEN THEY ASK. Not disclosing the conviction is grounds for immediate dismissal, among other things.

I think its removed from the driving record after 5-7 years but being in SC hard saying when they remove charges off of the record for good.

You could probably get it removed if you went to court to fight it but since it has been 3 years the records might still be fresh in the computer (well freshly archived where they are easy to access) they can be brought in and show the judge and if the judge wants to he/she could keep it on your record longer.

I guess they do that to show any employers who do background checks before hiring for any job.

In almost every state, your juvenile record can be expunged once you have reached adult age providing you were not a habitual offender.

Contact a lawyer - ask him how you can get your possession charge expunged in your state.

Once that is done, it should come off your driving record also.

Driving record and criminal record are two separate issues.
