If Congress could make him talk because he is just an employee of the presidents, as I was told in my last question, why didn't they subpoena him in the first place?

Two possible reasons.

The most hopeful is that Congress is laying the foundation for a massive Contempt of Congress action by giving each aide an opportunity to comply with (or violate) federal laws.

Or Congress could just be wasting their time -- if the don't follow up on all these blatant violations of federal law.

For those who haven't checked -- executive privilege does NOT give someone the right to refuse to show up in response to a Congressional subpoena -- it never has. It just allows the person to refuse to answer specific questions.

If Rove refuses to show up at all, like Miers did, that's a slam-dunk federal offense.

Petty politics IMO but the white house just keep giving dems ammunition.
